Tequila Giveaway Terms & Conditions

  1. Promoter
    The promoter is [INSERT LEGAL ENTITY NAME] trading as Tequila Brothers / Brothers Liquor Emporium, ABN [INSERT ABN], of [INSERT REGISTERED BUSINESS ADDRESS] ("Promoter").
  2. Promotion Period
    The promotion commences at [TIME] AEST/AEDT on [START DATE] and closes at [TIME] AEST/AEDT on [CLOSING DATE] ("Promotion Period").
    Entries received outside the Promotion Period will not be accepted.
  3. Eligibility
    Entry is open to Australian residents aged 18 years or over, excluding residents of the Northern Territory.
    Employees, officers and contractors of the Promoter, agencies directly associated with the promotion, and their immediate family members are not eligible to enter.
    The Promoter may require proof of age, identity and Australian residency before awarding the prize. If an entrant is unable to provide satisfactory proof, their entry may be deemed invalid and another winner selected.
  4. How to Enter
    To enter, eligible entrants must, during the Promotion Period:

    Complete the official giveaway entry form with the requested details, including their name, email address and date of birth; and
    Accept these Terms & Conditions and submit the completed entry form.
    Entry is free and no purchase is necessary.
    Unless expressly stated otherwise on the promotional landing page, each eligible person may submit one entry only.
    Incomplete, illegible, automated, fraudulent, duplicate or otherwise non-compliant entries may be deemed invalid.
  5. Marketing Consent
    Entering the promotion does not automatically require an entrant to consent to receiving marketing communications unless marketing consent is separately and clearly requested at the point of entry.
    Where an entrant elects to receive marketing communications from Tequila Brothers and/or the Promoter, their information may be used to send relevant news, offers, product information and marketing communications in accordance with the Promoter's Privacy Policy.
    Marketing consent may be withdrawn at any time using the unsubscribe facility provided in marketing communications.
  6. Prize
    There is one (1) prize to be won.
    The winner will receive a three-month Tequila Brothers Tasting Subscription, consisting of one Tequila Brothers Tasting Subscription pack per month for three consecutive months.
    Each monthly tasting pack currently includes 4 × 50ml curated tequila tasting bottles, together with the inclusions applicable to the Tequila Brothers Tasting Subscription.
    The total recommended retail value of the prize is AUD $237.
    The exact tequila expressions included in each month's pack may vary according to the Tequila Brothers subscription selection for that month and product availability.
    The prize is not transferable or exchangeable and cannot be redeemed for cash, except where required by law.
    If any component of the prize becomes unavailable for reasons outside the Promoter's reasonable control, the Promoter may substitute it with an item of equal or greater value, subject to applicable law and any required regulatory approval.
    No additional subscription charges will be payable by the winner for the three-month prize period. The prize will not automatically convert to a paid subscription at the end of the three months unless the winner separately elects to subscribe.
  7. Alcohol and Responsible Service
    The prize contains alcohol and will only be supplied to a person aged 18 years or over.
    The winner may be required to provide acceptable proof of age before the prize is dispatched or otherwise made available.
    Delivery of alcohol is subject to applicable liquor licensing requirements and any delivery restrictions applying to the winner's location.
    The Promoter supports the responsible consumption of alcohol.

  8. Winner Selection
    This is a game of chance. Skill plays no part in determining the winner.
    All valid entries received during the Promotion Period will be entered into the draw.
    The winner will be selected by random draw at [TIME] AEST/AEDT on [DRAW DATE] at [DRAW LOCATION / PROMOTER'S BUSINESS ADDRESS OR ELECTRONIC DRAW LOCATION].
    The first valid eligible entry randomly selected will win the prize.
    Each valid entry has an equal chance of winning.
    The Promoter reserves the right to verify the validity of entries and entrants and to disqualify any entrant who tampers with the entry process, submits an entry contrary to these Terms & Conditions, or otherwise acts fraudulently or improperly.
  9. Winner Notification
    The provisional winner will be contacted using the email address and/or telephone number provided with their entry within 2 business days of the draw.
    The winner must respond and provide any requested proof of eligibility, identity and age within 7 days of notification.
    The winner's details will be published where required by applicable law. In South Australia, current rules generally require publication within 30 days for prizes worth more than $250, subject to the winner's ability to request that their details not be published.
  10. Unclaimed Prize / Redraw
    If the winner cannot be contacted, does not claim the prize within the stated claim period, fails to establish eligibility, or otherwise forfeits the prize, the Promoter may conduct an unclaimed prize draw, subject to applicable law.
    The unclaimed prize draw will take place at [TIME] AEST/AEDT on [REDRAW DATE] at [LOCATION].
    Any replacement winner will be notified using the contact details supplied with their entry.
    The Promoter will make reasonable efforts to contact the original winner before conducting a redraw.
  11. Privacy
    The Promoter collects entrants' personal information for the purposes of administering the promotion, verifying eligibility, contacting and announcing the winner, delivering the prize and otherwise conducting the promotion.
    Where an entrant separately provides marketing consent, the Promoter may also use their personal information for marketing purposes in accordance with that consent and the Promoter's Privacy Policy.
    Personal information may be disclosed to service providers assisting with the administration of the promotion, including website, CRM, email, fulfilment, delivery and technology providers, where reasonably necessary.

  12. General Conditions
    The Promoter accepts no responsibility for entries that are lost, delayed, misdirected, incomplete or not successfully submitted because of technical, telecommunications or other problems outside its reasonable control.
    If the promotion cannot be conducted as reasonably anticipated due to circumstances beyond the Promoter's reasonable control, the Promoter may modify, suspend, terminate or cancel the promotion where permitted by law and subject to any required regulatory approval.
    Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
    To the extent permitted by law, the Promoter is not responsible for loss or damage arising from participation in the promotion or acceptance or use of the prize, except to the extent caused by the Promoter's negligence, fraud, wilful misconduct or breach of a non-excludable statutory guarantee.
    The Promoter's decision regarding the administration of the promotion and determination of the winner is final, subject to applicable law.
  13. Facebook and Instagram
    This promotion is in no way sponsored, endorsed, administered by, or associated with Facebook or Instagram.
    Entrants release Facebook and Instagram from any liability arising from or in connection with this promotion to the extent permitted by law.
    Entrants provide their information to the Promoter and not to Facebook or Instagram.

    By entering the promotion, entrants acknowledge that they have read and agree to these Terms & Conditions.
